# Eco-Villages and Off-Grid Property on the Nicoya Peninsula: What to Check Before You Buy

> Eco and off-grid property on the southern Nicoya Peninsula is usually a farm or a home on acreage with its own water. The rules on wells, rainwater, solar, septic systems, road access, forest setbacks and eco-village ownership, and the papers that prove a property meets them.

Off-grid property in Costa Rica's southern Nicoya Peninsula usually means a farm or a house on a few acres with its own water source, often beside forest or a river. An eco-village, where owners share land, roads and water under one set of rules, is less common and works under a separate law. Either way, six things decide whether a property can be lived on and built on: a legal water supply, power, a septic system that meets the rules, road access, the forest and river setbacks, and how ownership is registered. Below is what Costa Rican law says about each, with the documents that show a property complies. All sources were checked on 3 November 2026 and are listed at the end. To see what is on the market now, browse our [Eco & Off-Grid listings](/properties/eco-off-grid).

## Water

### Public supply

Rural water in Cóbano district comes from AyA, the national water utility, or from an ASADA, a community water association that AyA supervises under [Decree 42582-S-MINAE](https://leap.unep.org/en/countries/cr/national-legislation/decreto-no-42582-s-minae-reglamento-de-las-asociaciones). In January 2026 the Cóbano district council budgeted ₡130.4 million for supplies to the district's ASADAs ([council minutes 091-2026](https://www.municobano.go.cr/images/conozcanos/concejo/Actas/actas2026/ordinarias/ACTA_N091-2026.pdf)).

A new house needs a water-availability letter (carta de disponibilidad de agua) from the provider that serves the area. Providers can refuse one: in May 2026 the engineers' college, CFIA, said water providers often turn down new projects for lack of capacity, and that AyA serves about half the country's connections and ASADAs about 29% ([El Observador, 20 May 2026](https://observador.cr/falta-de-capacidad-de-agua-y-tramites-burocraticos-retrasan-construccion-de-viviendas-advierte-cfia/)). On a lot where you plan to build, the letter belongs with the purchase documents.

### Wells

The Water Law, [Ley 276](https://www.senara.or.cr/acerca_del_senara/marco_legal/leyes_senara/leyes_generales/276%20%20%20Ley%20de%20aguas.pdf), lets an owner open a well on their own land for household use without a water concession (article 6). In the countryside a new well must sit at least 15 m from a neighbour's wells, tanks and springs. Drilling still needs a permit from MINAE's water directorate, with a technical opinion from SENARA, the groundwater agency, which gives each well a number. A well drilled without a permit cannot later get a concession and can be sealed ([El Financiero, 8 April 2016](https://www.elfinancierocr.com/opinion/un-pozo-ilegal-es-un-mala-inversion/D2VFAUNLWZDJJCUCEHEVMLHEVM/story/)). A property sold with a well should come with the drilling permit, the SENARA well number and a recent flow and water-quality test.

### Springs and streams

Drawing water from a spring or stream requires a water concession in the owner's name, and a property that holds one is worth more than one that only has the spring. Ley 276 also reserves to the State the land within at least 200 m of a public drinking-water intake (article 31a).

### Rainwater

Rain that falls on your land is yours to store (Ley 276, article 4). Decree 43100-MINAE, the rainwater-harvesting rule of October 2021, allows storage of up to 5,000 m³ without an environmental study or a concession, provided the system is registered with the water directorate ([Periódico Mensaje, 3 November 2021](https://www.periodicomensaje.com/guanacaste/7805-nuevo-decreto-facilita-construccion-de-reservorios-para-cosecha-de-lluvia); [Tactic Legal, 2 March 2022](https://tactic.legal/reglamento-para-la-cosecha-de-lluvia/)). For a house it makes a good reserve for the dry season.

## Power

ICE, the national electricity company, serves Cóbano district; in October 2024 it upgraded 15 km of line in Santa Teresa and Manzanillo serving about 4,000 connections ([Delfino, 16 October 2024](https://delfino.cr/2024/10/ice-refuerza-servicio-electrico-en-santa-teresa-y-manzanillo-ante-temporada-alta-turistica)). Outside Cóbano district, the electricity provider depends on the exact location.

Solar is covered by Ley 10086 on distributed energy (December 2021) and its regulation, Decree 43879-MINAE (February 2023) ([UNEP law database](https://leap.unep.org/en/countries/cr/national-legislation/ley-10086-del-8-de-diciembre-del-2021-promocion-y-regulacion-de)). The law's final text recognises systems with no grid connection at all ("operación en isla") and exempts renewable systems under 500 kVA, connected or not, from municipal permits and environmental review ([final legislative text, October 2021](https://d1qqtien6gys07.cloudfront.net/wp-content/uploads/2021/10/Dictamen_22009REDACCION-FINAL.pdf), articles 2 and 10). A house system is far below that size.

Keeping the grid connection and adding panels brings ICE charges. Its July 2026 tariff sheet lists an access charge of ₡25 per kWh on the energy you generate yourself and ₡255 a month per installed kW, and ICE buys surplus power at ₡27.40 per kWh by day and ₡19.04 at night, all before VAT ([ICE tariff sheet, July 2026](https://www.grupoice.com/wps/wcm/connect/6b387ffa-400d-41dd-85aa-76e36daffb20/TARIFAS+APLICABLES+A+RECURSOS+ENERGETICOS+DISTRIBUIDOS+JULIO+2026.pdf?MOD=AJPERES&CVID=p-KoBM8)). These charges have changed before. After owners reported bills up more than 400%, the regulator ARESEP changed how the access charge applies in 2024 ([Semanario Universidad, 25 September 2024](https://semanariouniversidad.com/pais/aresep-corrije-metodologia-que-afectaba-a-hogares-y-negocios-que-producian-electricidad-con-paneles-solares/)), and in June 2026 the Constitutional Court gave ARESEP two months to finish the tariffs the law requires ([El Observador, 12 June 2026](https://observador.cr/sala-iv-da-dos-meses-al-regulador-general-para-fijar-tarifas-de-generacion-distribuida-de-energia-renovable/)). Any savings figure for a grid-tied system should be worked out on the current tariff.

An existing solar installation should come with the installer's details, the battery age and capacity, and, if it is grid-tied, the ICE interconnection papers. Of the parts in a solar system, the batteries wear out first.

## Septic systems

Off-grid houses use a septic tank and drainfield, regulated by Decree 42075-S-MINAE as amended by Decree 44041-S-MINAE in 2023 ([text on FAOLEX](https://faolex.fao.org/docs/pdf/cos220698.pdf)). The rule defines the septic tank as the solution for single-family homes and other uses with wastewater flows of up to 5 m³ a day, which it equates to 190 m³ of water a month; above that, wastewater must pass through an approved treatment system first (article 8). The water table must be at least 1.5 m below the bottom of the drainfield trench, infiltration tests are filed with the building plans, and the tank must be pumped at least every two years. The minimum distances for the drainfield are in the table in the next section.

## Setbacks from springs, rivers and boundaries

The Forestry Law, [Ley 7575](https://www.acto.go.cr/wp-content/uploads/2020/04/Ley7575.pdf), protects much of what draws people to eco property. Forested land cannot change use (article 19), though MINAE can allow a house, a road or ecotourism on private forest land after a screening. Articles 33 and 34 create protected strips where no trees may be cut, and the septic rule adds its own distances:

| Feature | Minimum distance | Rule |
|---|---|---|
| Permanent spring | 100 m radius | Ley 7575, art. 33 |
| River or stream, flat rural land | 15 m each side | Ley 7575, art. 33 |
| River or stream, flat land in town | 10 m each side | Ley 7575, art. 33 |
| River or stream, broken ground | 50 m each side | Ley 7575, art. 33 |
| Lake | 50 m | Ley 7575, art. 33 |
| Drainfield to property line or building | 1 m | Decree 42075-S-MINAE, art. 10 |
| Drainfield to slope | 2 m | Decree 42075-S-MINAE, art. 10 |
| Drainfield to water tank | 3 m | Decree 42075-S-MINAE, art. 10 |
| Neighbour's well, tank or spring (new well, countryside) | 15 m | Ley 276, art. 6 |

On a farm with a river and a spring, these strips can take a large share of the land out of use, so the usable area is worth mapping before you compare prices per acre. On a sloping lot near a stream, the septic distances often decide where the house can go.

## Building permits

SETENA, the environmental agency, sets the review by the size of the build. A building under 500 m² needs no environmental impact assessment and follows the environmental good-practice code (Decree 32079); between 500 and 1,000 m² in an environmentally fragile area it needs an assessment on form D1-C ([SETENA FAQ](https://www.setena.go.cr/es/FAQs-SETENA); Decree 43898, in force since August 2023). Near the coast, building also depends on the coastal zoning plans. Cóbano district has 11 of them, most about 20 years old, and a combined plan for Mal País to Manzanillo is under review at SETENA ([council minutes 091-2026](https://www.municobano.go.cr/images/conozcanos/concejo/Actas/actas2026/ordinarias/ACTA_N091-2026.pdf)). Our [beachfront guide](/magazine/beachfront-property-nicoya-costa-rica-buyers-guide) covers the coastal zone in detail.

## Road access

Rural property here is reached either by a public road or across a neighbour's land. A private access is a right of way (servidumbre de paso) and should be registered: it appears on the title of both properties in the National Registry and on the survey plan. A handshake agreement to cross a neighbour's land is not a registered right and can end when that land is sold.

Land with no exit to a public road can obtain a forced right of way through the courts under article 395 of the Civil Code, and the owner of the land crossed must be paid for the strip used and any other damage ([La Nación, 16 May 2026](https://www.nacion.com/blogs/por-tanto/servidumbres-de-paso-en-costa-rica-vea-cuando/OXQLBXGH6NCNFL3ZNLQPFBCMPM/story/)). That process takes time and money, so a lot should be bought with its access already registered.

Many roads to rural lots around Cóbano are gravel or dirt, and some steep stretches need four-wheel drive after heavy rain. Drive the road in the wet season as well as the dry one, and check whether a stream crossing has a bridge.

## How eco-village ownership works

A well-organised eco-village is a condominium under [Ley 7933](https://munibuenosaires.go.cr/wp-content/uploads/2025/03/Ley-7933-Ley-Reguladora-de-la-propiedad-en-Condominio.pdf), the Condominium Law, which allows rural land to be placed under the regime (article 1). Each owner holds a registered unit (finca filial) with its own title and a share of the common land, roads and water system.

A condominium must be approved by INVU, the housing and planning institute, by the Ministry of Health and by the municipality (article 3). Its rules are part of the founding deed (article 4) and must cover the administrator and the fees (article 33); this is where rules on building style, animals, short-term rentals and shared farming are written. Shared costs are split by unit size (articles 9 and 19). On a sale, the seller must give the notary a certificate from the administrator showing the fees are paid, or the buyer becomes liable for any debt (article 21). Changing the condominium's purpose or founding deed needs the agreement of every owner (article 27), which protects the green areas and also makes the rules hard to change.

Some eco-communities use other structures: shares in a company that owns the land, or "rights" (derechos) in a shared property with a private agreement on who uses which part. Under these arrangements the buyer holds no parcel that can be registered, mortgaged or sold separately, and disputes fall outside the Condominium Law. Unregistered land carries its own risks, since a survey plan (plano catastrado) is not proof of ownership and a new title obtained through possession can be challenged for three years ([Tico Times, 29 April 2015](https://ticotimes.net/2015/04/29/title-me-this-the-perils-and-promise-of-buying-untitled-land-in-costa-rica)). Title fraud is a live problem too: in 2021 prosecutors were investigating about 70 notaries for notarial and registry fraud, and advised owners to check the National Registry two or three times a year to confirm their property is still in their name ([El Observador, 5 April 2021](https://observador.cr/ministerio-publico-investiga-a-mas-de-70-notarios-por-delitos-de-fraude-notarial-y-registral/)). For every purchase, we'll introduce a local lawyer who searches the title in the National Registry before any money moves.

## The documents to see before an offer

1. Water: the availability letter, or the well's drilling permit and SENARA number, or the concession for a spring or stream, plus a recent flow and quality test.
2. Power: the provider serving the lot and the distance to its nearest line; for solar, the installer's details, battery age and any interconnection papers.
3. Septic: the location of the tank and drainfield, and room on the lot to meet the distances for a new house.
4. Road: a public road, or a right of way registered on the title, and a road you have driven in the wet season.
5. Forest and rivers: a map of the protected strips and the usable area left.
6. Permits: a land-use certificate from the Cóbano council and, near the coast, what the zoning plan allows.
7. Ownership: a registered title or condominium unit, the condominium rules and a fee certificate, and a clean Registry search.

## Frequently asked questions

### Can I drill a well on my land in Costa Rica?

Yes. The Water Law lets an owner open a well for household use without a water concession, but drilling needs a permit from MINAE's water directorate and a SENARA technical opinion. A well drilled without a permit cannot later get a concession and can be sealed.

### Do I need a permit for off-grid solar in Costa Rica?

Ley 10086 exempts renewable systems under 500 kVA, whether connected to the grid or fully off-grid, from municipal permits and environmental review. A grid-tied system still pays ICE an access charge, ₡25 per kWh of self-generated energy in July 2026.

### How far from a river can I build in Costa Rica?

The Forestry Law protects a strip of 15 m on each side of a river or stream on flat rural land, 10 m in town and 50 m on broken ground, plus a 100 m radius around permanent springs. No trees may be cut inside these strips.

### Is a lot in an eco-village titled?

It is if the eco-village is a condominium under Ley 7933: each owner holds a registered unit (finca filial) with its own title. A share in a company or "rights" in a shared property give no parcel that can be registered, mortgaged or sold on its own.

### Can I use a septic tank for an off-grid house?

Yes. The wastewater rule allows a septic tank and drainfield for single-family homes and other uses up to 5 m³ of wastewater a day, provided the water table is at least 1.5 m below the trench and the drainfield keeps its minimum distances.
